1. Acceptance of Terms

By accessing and using Nekkha ("the Platform"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Global Usage Guidelines

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You are prohibited from:

  • Violating any applicable national or international laws or regulations.
  • Exploiting, harming, or attempting to exploit or harm minors.
  • Transmitting any unsolicited or unauthorized advertising (spam).
  • Impersonating Nekkha, a Nekkha employee, or any other person or entity.
India

3. Compliance with Indian Laws

For users accessing Nekkha from India, these Terms are governed by the Information Technology Act, 2000 and its applicable rules, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Grievance Officer: In accordance with the IT Act, users may contact our Grievance Officer regarding any violation of these terms or other concerns at grievance@nekkha.com.

  • Users must not host, display, upload, modify, publish, transmit, store, update or share any information that belongs to another person and to which the user does not have any right.
  • We reserve the right to terminate access to users who repeatedly infringe strict copyright or privacy laws.
Saudi Arabia

4. Compliance with Saudi Arabian Laws

For users accessing Nekkha from the Kingdom of Saudi Arabia (KSA), these Terms are subject to the E-Commerce Law and the regulations set forth by the Ministry of Commerce.

  • Electronic Contracts: Electronic contracts and records are considered valid and enforceable in accordance with KSA law.
  • Consumer Protection: Users are entitled to clear information regarding service providers, characteristics of goods/services, and total price including taxes.
  • Prohibited Content: Any content violating the principles of Islamic Sharia or public order/morals in KSA is strictly prohibited and will be removed immediately.

5. User Accounts & Security

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party.

6. Limitation of Liability

In no event shall Nekkha, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
